By purchasing this program, you are agreeing to a 12-month contract starting on the date of purchase.

By purchasing this program, you are agreeing to allow Hulafrog to charge your credit card monthly for 12 months. 

You are being asked to create a password at purchase so you can immediately get access our Advertiser Portal where you'll find our Ads Templates Portal as well as get guidance on how to get started with your plan! 

You will receive a copy of these terms via email after you purchase the program.

 Program Terms

 Advertiser may choose to have Hulafrog design first graphic ad free of charge.   Advertiser shall provide copy, logos and other graphics as needed.  Ads click through to any page on your website. All ads rotate equally to ensure all advertisers receive premium positioning.  Advertiser may change creative at any time with 48 hours notice. Annual advertisers get one free set of graphic ads (300x250 and 728x90).  Changes to ads are charged at $30 an hour. Text-only changes are a flat fee of $15.  A new set of ads can be created at $75 for two ads. Access to the Ads Template Portal enables you to create your own ads at no charge.

 Standard Terms and Conditions

1. Limitations of Liability. In the event (i) that Hulafrog fails to publish an advertisement in accordance with the schedule provided in the Insertion Order, (ii) Hulafrog fails to deliver the number of total e-mails specified in the Insertion Order (if any) by the end of the specified period, or (iii) of any other failure, technical or otherwise, of such advertisement to appear as provided in the Insertion Order, the sole liability of Hulafrog to Advertiser shall be limited to, at Hulafrog’s sole discretion, a pro rata refund of the advertising fee or other advertising space of comparable value and placement. In no event shall Hulafrog be responsible for any consequential, special, punitive or other damages, including without limitation, lost revenue or profits. Hulafrog shall have no liability for any failure or delay resulting from any governmental action, fire, flood, insurrection, earthquake, power failure, riot, explosion, embargo, strikes, labor or material shortage, transportation interruption of any kind work slowdown or any other condition beyond the control of Hulafrog.
2. Cancellation Policy: Pricing and benefits are based on annual contract. If advertiser cancels, advertiser is responsible to pay the difference in the quarterly vs. annual pricing for the time serviced plus a $75 creative fee.  Cancelations must be received 7 days prior to billing. No refunds are given.
3. Advertisers Representations; Indemnification. Advertisements (display ads, text ads or ad copy) are accepted upon the representation that Advertiser has the right to publish the contents of the advertisement without infringing the rights of any third party and without violating any law. In consideration of such publications, Advertiser agrees, at its own expense, to indemnify, defend and hold harmless Hulafrog, and its employees, representatives, agents and affiliates, against any and all expenses and losses of any kind (including reasonable attorney's fees and costs) incurred by Hulafrog in connection with any claims, administrative proceedings or criminal investigations of any kind arising out of publication of the advertisement and/or any material, product or service of Advertiser to which users can link through the advertisement (including without limitation, any claim of trademark or copyright infringement, defamation, breach of confidentiality, privacy violation, false or deceptive advertising or sales practices).
4. Provision of Advertising Materials. Advertiser will provide all materials for the advertisement in accordance with Hulafrog' policies in effect from time to time, including (without limitation) the manner of transmission to Hulafrog and the lead-time prior to publication of the advertisement. Hulafrog shall not be required to publish any advertisement that is not received in accordance with such policies and reserves the right to charge Advertiser, at the rate specified on this purchase page, for inventory held by Hulafrog pending receipt of acceptable materials from Advertiser which are past due. Advertiser hereby grants to Hulafrog a non-exclusive, worldwide, fully paid license to use, reproduce and display the advertisement (and the contents, trademarks and brand features contained therein) in accordance herewith.
5. Right to Reject Advertisement. All Contents of advertisements are subject to Hulafrog' approval. Hulafrog reserves the right to reject any advertisement at any time, for any reason whatsoever.

6.  Miscellaneous. These Standard Terms, together with this Purchase Contract and Program Details, shall be governed by and construed in accordance with, the laws of the State of New Jersey. Both parties consent to the jurisdiction of the courts of the state of New Jersey with respect to any legal proceeding arising in connection with the Standard Terms on this page.
